KallyConfidence is a phone anxiety coaching app that helps you practice phone calls in a safe environment. By using the App, you agree to use it responsibly. The App is not a substitute for professional mental health treatment.
Welcome to KallyConfidence. These Terms of Service ("Terms") govern your use of the KallyConfidence mobile application ("App") operated by KALLY INTELLIGENCE, INC., a Delaware corporation ("we", "us", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

The App may enable access to third-party services and content. You agree to use such external services at your sole risk. We are not responsible for examining or evaluating the content or accuracy of third-party services and shall not be liable for any such services. Data displayed by the App for general informational purposes is not guaranteed.
KallyConfidence is not a medical device and does not provide medical advice, diagnosis, or treatment. It is designed as a self-help tool for building confidence with phone calls. If you are experiencing severe anxiety or mental health issues, please consult a qualified healthcare professional.
You must be at least 13 years old to use KallyConfidence. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent's or guardian's permission to use the App.
KallyConfidence does not require account creation. The App uses a device-specific identifier to provide personalized experiences. Your progress and data are stored locally on your device by default.
You may choose to create an account using Sign in with Apple or Google Sign-In. Account registration enables:
When you create an account, your progress data is stored on our servers in addition to your device. You can delete your synced data at any time through the App's Settings. See our Privacy Policy for details on how we handle your synced data.
KallyConfidence offers optional premium subscriptions through the Apple App Store that provide additional practice call minutes and features.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription through your Apple ID account settings. Refunds are handled according to Apple's refund policy.
When using KallyConfidence, you agree not to:
Subject to your compliance with these Terms, KALLY INTELLIGENCE, INC. grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.
The App, including its content, features, and functionality, is owned by KALLY INTELLIGENCE, INC. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
Any content you create within the App (such as journal entries) remains your property. By using the App, you grant us a limited license to process your content solely to provide the App's features. We do not claim ownership of your content.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KALLY INTELLIGENCE, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless KALLY INTELLIGENCE, INC. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the App or violation of these Terms.
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
If you are a consumer residing in the European Union, you retain the benefit of any mandatory provisions of your local consumer protection laws. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Effective Date" and, where appropriate, through in-app notification. Your continued use of the App after changes constitutes acceptance.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

When you download KallyConfidence from the Apple App Store, your use of the App is also governed by Apple's Licensed Application End User License Agreement (the "Apple EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of any conflict between these Terms and the Apple EULA, the Apple EULA shall prevail with respect to your use of the App obtained through the Apple App Store.

You may not use or export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. By using the App, you represent that you are not located in any U.S.-embargoed country or on any U.S. Treasury Department's Specially Designated Nationals List or Commerce Department's Denied Persons List.
